The Services
These Terms of Service (“Terms”) govern your use of the Logika website, applications and services (the “Services”) provided by Organic Search Inc. (“Logika”, “we”, “us”). By using the Services you agree to these Terms. If you use them for an organization, you confirm you can bind that organization. Logika provides an operations and communications platform for dental and specialty practices. We may add, change or remove features over time.
Accounts
- Provide accurate information and keep your credentials secure.
- You are responsible for activity under your account.
- You must be at least 18 years old to create an account.
Acceptable use
You must follow our Acceptable Use Policy. Among other things, you may not send unsolicited messages, use purchased or scraped contact lists, ignore opt-outs, or use the Services for unlawful, harmful or deceptive purposes.
Messaging compliance
If you use Logika to send email, SMS or voice communications, you are responsible for having a lawful basis and any required consent for each recipient, keeping records of it, and honoring opt-outs, in line with our Email Practices, SMS Messaging Policy and applicable law.
Customer data and privacy
Our Privacy Policy also applies. You keep ownership of the data you submit and grant us a limited license to host and process it only to provide the Services. Where you submit protected health information, the applicable Business Associate Agreement governs our processing.
Fees
Paid features are billed according to your plan or order. Fees are non-refundable except where the law or your order says otherwise. We may change prices for future billing periods with notice.
Intellectual property
Logika and its licensors keep all rights in the Services, including software, designs and trademarks.
Third-party services
The Services connect with third-party providers such as telephony, email delivery, payments, practice management software and advertising platforms. Their terms may apply to your use of those integrations.
Disclaimers and liability
The Services are provided “as is” and “as available”, to the extent the law allows. We are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or data. Our total liability for any claim is limited to the amounts you paid us in the 12 months before the claim.
Suspension and termination
You may stop using the Services at any time. We may suspend messaging features immediately, or suspend or terminate access, for violations of these Terms or the Acceptable Use Policy or to protect the Services and recipients.
Governing law
These Terms are governed by the laws of the State of New York, without regard to conflict-of-laws rules. Disputes are resolved in the courts located in New York County, New York.
